The Land Rover might be held liable as he was the one passing in the right lane which is not prohibited in Florida. However, you can see the Land Rover passed the semi, which is 70-80 feet long, in approximately 3 seconds, so the Land Rover was going between 23.3 ft/s(17 MPH) and 26.6 ft/s(18 MPH) faster than the flow of traffic, so he was probably speeding.
